I. Basic Provisions

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
II. Sources and Categories of Processed Personal Data
- The controller processes personal data that you have provided or personal data that the controller has obtained based on the fulfillment of your order or with your consent.
- The controller processes your identification and contact details and data necessary for the performance of the contract, in particular: name, surname, e-mail address, telephone number, residential address, registered office address or delivery address, and other data provided by you during registration or when concluding the contract (order).
III. Legal Basis and Purpose of Personal Data Processing
- The legal basis for the processing of personal data is:
- the performance of a contract between you and the controller pursuant to Article 6(1)(b) GDPR,
- the legitimate interest of the controller in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
- your consent to processing for the purposes of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in accordance with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, if no order for goods or services has been placed.
- The purpose of processing personal data is:
- to process your order and fulfill the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, the above-mentioned categories of personal data are required, which are necessary for the successful processing of the order; the provision of personal data is a necessary requirement for the conclusion and performance of the contract; without the provision of personal data, it is not possible to conclude the contract or for the controller to fulfill it,
- sending commercial communications and carrying out other marketing activities.
- The controller does not engage in automated individual decision-making within the meaning of Article 22 GDPR.
IV. Recipients of Personal Data (Controller's Subcontractors)
- Recipients of personal data are persons:
- involved in the transport and delivery of goods, services, or in the execution of payments based on a contract,
- providing e-shop operation services (www.prelepkynaklavesnici.cz) and other services and support services related to the operation of the e-shop, such as IT services, accounting, etc.,
- providing marketing services.
- For the successful processing and delivery of the order, the controller is entitled to visibly state personal data on the delivered shipment, to the extent of the customer's name, surname, address, and telephone number.
- The controller does not intend to transfer personal data to a third country (a country outside the EU) or an international organization.
V. Your Rights
- Under the conditions stipulated in the GDPR, you have:
- the right to access your personal data pursuant to Article 15 GDPR,
- the right to rectification of personal data pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR.
- the right to erasure of personal data pursuant to Article 17 GDPR.
- the right to object to processing pursuant to Article 21 GDPR, and
- the right to data portability pursuant to Article 20 GDPR.
- in the case of data processing based on consent, the right to withdraw the granted consent in writing or electronically to the address or email of the controller specified in Article III of these conditions.
- Furthermore, you have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to the protection of personal data has been violated.
VII. Conditions for Securing Personal Data
- The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
- The controller has taken technical measures to secure data storage and paper-based personal data storage.
- The controller declares that only authorized persons have access to personal data.
VIII. Processing Period
- The controller stores personal data in a form that permits your identification for:
- the period necessary for the performance of the rights and obligations arising from the contractual relationship between you and the controller and the assertion of claims from these contractual relationships (for a period of 5 years from the termination of the contractual relationship or the completion of the order).
- in the case of data processing based on your consent, until the withdrawal of your consent.
- After the expiry of the personal data retention period, the controller will erase the personal data and all its copies and records.
IX. Final Provisions
- By submitting an order from the online order form, you confirm that you have read the conditions for the protection of personal data and that you accept them in their entirety.
- The controller is entitled to change these conditions. The new version of the personal data protection conditions will be published on the controller's website and at the same time, the new version of these conditions will be sent to your e-mail address that you provided to the controller.
These conditions come into effect on February 8, 2025.
